Calm Blue Coaching – Terms and Condition

1. General Information
1.1. These Terms and Conditions apply to all services provided by Calm Blue Coaching (hereinafter referred to as “the Coach”), registered in The Netherlands under Kamer van Koophandel number 65467973 and located at Herenlaan 28, 5708 ZS Helmond.

1.2. By using the services of the Coach, the client (hereinafter referred to as “the Client”) agrees to be bound by these Terms and Conditions.

1.3. The Coach reserves the right to amend or supplement these Terms and Conditions at any time. The most recent version will be published on the website.

 

2. Services

2.1. The Coach provides coaching services focused on self-development and positive change.

2.2. The Coach does not provide medical, psychological, legal, or financial advice. Coaching is not a substitute for professional services in these areas.

2.3. The scope of the services will be agreed upon by the Coach and the Client prior to the commencement of the coaching sessions.

 

3. Agreement

3.1. An agreement between the Coach and the Client is established when the Client confirms a coaching session or program in writing, verbally, or through the website.

3.2. The Client is responsible for providing accurate and complete information required for the services to be rendered.

3.3. The Coach has the right to refuse a client or terminate an agreement if the Client fails to comply with these Terms and Conditions or if the Coach believes that the coaching relationship is not in the best interest of either party.

 

4. Payment and Fees

4.1. The fees for coaching services are outlined on the website or agreed upon separately in writing.

4.2. Payment for services must be made in advance, unless otherwise agreed in writing, within 7 days of the invoice being sent to the client.

4.3. Payment must be made by bank transfer, unless otherwise agreed in writing.

4.4. In case of late payment, the Client is in default without the need for further notice, and the Coach has the right to charge statutory interest as per Dutch law.

4.5. Payment is for the coaching services provided by the Coach, and is not contingent upon the outcome or results of the coaching. The Client acknowledges that the effectiveness of coaching depends on the Client’s active participation and commitment.

4.6. All fees are inclusive of BTW unless otherwise stated.

 

5. Cancellation and Rescheduling

5.1. The Client must provide at least 24 hours notice if they wish to cancel or reschedule a coaching session.

5.2. If the Client cancels a session with less than 24 hours’ notice or fails to attend a session, the full fee will be charged.

5.3. The Coach reserves the right to cancel or reschedule a session in case of illness, emergency, or other unforeseen circumstances. In such cases, the Client will be notified as soon as possible, and the session will be rescheduled without additional cost.

6. Confidentiality

6.1. All information shared by the Client during coaching sessions will be treated as confidential unless disclosure is required by law.

6.2. The Coach will take all reasonable measures to protect the confidentiality of the Client’s information but is not responsible for information intercepted by third parties during the communication process.

 

7. Liability

7.1. The Coach’s liability for damages arising from or related to the services provided is limited to the amount paid by the Client for the services that caused the damage.

7.2. The Coach is not liable for any indirect, incidental, or consequential damages.

7.3. The Client acknowledges that they are responsible for their own actions and decisions during and after the coaching sessions.

 

8. Intellectual Property

8.1. All materials provided by the Coach, including but not limited to written content, tools, and resources, are protected by copyright and may not be reproduced, distributed, or used for commercial purposes without the prior written consent of the Coach.

8.2. The Client may use these materials solely for their personal use.

 

9. Complaints and Disputes

9.1. If the Client has a complaint about the services provided, they should inform the Coach as soon as possible in writing.

9.2. The Coach will strive to resolve the complaint in a fair and timely manner.

9.3. In the event of a dispute that cannot be resolved amicably, the dispute will be submitted to the competent organisation in the Netherlands.

 

10. Governing Law

10.1. These Terms and Conditions are governed by and construed in accordance with the laws of The Netherlands.

10.2. Any legal action or proceeding arising under these Terms and Conditions will be brought exclusively in the courts of The Netherlands.

 

11. Final Provisions

11.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.2. These Terms and Conditions constitute the entire agreement between the Coach and the Client and supersede all other agreements or understandings, whether written or oral.
